Chicago Title, the 6th U.S. Circuit Court of Appeals determined that a class could not be certified in a reissue rate case based on the class description, and that the district court did not abuse its discretion by refusing to adopt a proposed case management plan that would have created subclasses to overcome a predominance barrier.
