The Virginia General Assembly prefiled legislation that would remove the requirement that a person applying for recommission as a notary or electronic notary include in their application an applicant oath, provided that the person is in good standing as a notary or electronic notary and would not be subject to any investigation or proceeding, or has never been removed from office.
The bill, SB 8, was prefiled by Sen. Bryce Reeves, R-Fredericksburg.
The bill would amend Section 47.1-5.1 of the Code of Virginia to state, “Persons already commissioned as notaries public or electronic notaries public pursuant to this title and who are submitting application for recommissions as a notary or electronic notary may submit applications to the secretary in person, by first class mail, or online. No person applying for recommission shall be required to include the oath of the applicant required for commission by Section 47.1-5, provided that such applicant is in good standing as a notary public or electronic notary public, and is not subject to any investigation or proceeding, or has never been removed from office pursuant to Chapter 5.”
