A former sales executive sued his former employer and the employer’s potential merging partner under the Cartwright Act, California’s antitrust statute, after being told there were limitations to how he could compete for the merging partner’s clients. He said the limitations caused him to lose sales commissions and ultimately be terminated. The merging partner was granted summary judgment and the former employee appealed.
