Ohio Supreme Court addresses standing in foreclosure appeal

Days before a scheduled sheriff’s sale, homeowners moved to vacate the foreclosure decree in their case, alleging that the bank fraudulently claimed to have standing when it did not. The Ohio Supreme Court was asked whether this allegation could be grounds for vacating the foreclosure judgment and whether, because of the alleged fraud, the trial court lacked subject-matter jurisdiction.
