The Montana Legislature is considering a bill that would provide that defects in or liens or encumbrances on a title include delinquent municipal utility fees.
The bill, SB 289, was introduced by Sen. Frederick Moore, R-Miles City.
The bill would revise the definition of “title insurance policy” to state that it is a contract by which a title insurer insures or indemnifies the insured against loss or damage sustained by reason of “defects in or liens or encumbrances on the title to the stated property, including delinquent fees owed to a municipality for utility services provided to the property.”
