Homeowner seeks damages after claim denial

After a dispute arose with a neighbor regarding the ownership and use of a driveway, the owner of property in Scarsdale, N.Y., sought coverage from their title insurer. When the title insurer denied the claim because it was excepted from coverage, the owner sued. The case eventually went before the Supreme Court of New York Appellate Division: Second Judicial Department.
