Arizona considers exemption to lien fees

The Arizona Legislature is considering legislation that would prohibit county recorders from charging a fee to record or release a restitution lien. The bill, SB 1089, was introduced by Sen. Thomas Shope, R-Coolidge.
The bill notes that county recorders receive the following fees:
- If a fee is not otherwise specified, $30 for recording papers required or authorized by law
- For recording papers to which the United States, Arizona or any political subdivision of the state, when recorded at the request of the United States, Arizona or the political subdivision, $15 per instrument
- For recording preparing and certifying copies of a record in the recorder’s office, $1 per page and $3 for attaching the recorder’s certificate and seal
- For issuing a certificate pursuant to Section 47-9523, $10 per name, plus $1 for each financing statement or statement of assignment reported therein.
The bill proposes the following, “Notwithstanding any other law, the county recorder shall not receive a fee for performing the duties prescribed by this section or any act necessary to record or release a restitution lien filed pursuant to Section 13-806 or any lien necessary to enforce a support order.”
