The Oklahoma Legislature is considering legislation that would provide that a title insurance company could not charge a fee for the filing of a release of mortgage affidavit.
The bill, HB 4151, would amend 36 O.S. 2021, Section 5008 (c) to include the following, “An authorized officer of a title insurance company or a duly appointed agent of the title insurance company shall not require a mortgagor or a judgment debtor to pay a fee associated with the affidavit referenced in this paragraph.”
If adopted, the bill would become effective Nov. 1.
