The Oklahoma State Legislature is considering legislation that would permit certified copies to be made in accordance with the Uniform Real Property Electronic Recording Act. The bill, SB 569, was introduced by Sen. Joe Newhouse, R-Tulsa.
The bill would amend 19 O.S. 2011, Section 245 (A) to add the following sentence, “Certified copies may be provided in paper or digital format in accordance with the Uniform Real Property Electronic Recording Act.”
It also amends 19 O.S. 2011, Section 285 to read, “The register of deeds shall keep a seal, to be furnished by the county, which seal shall contain the name of the county, the words ‘Oklahoma’ and ‘register of deeds.’ Except as provided in the Uniform Real Property Electronic Recording Act, he or she shall attach such seal to all instruments filed or recorded in their office, together with their signature and certificate to all certified copies of any instrument on file or of record in their office, which he or she is required to issue.”
If adopted, the bill would go into effect Nov. 1, 2021.
