Nevada Supreme Court addresses quiet title questions from Ninth Circuit

The Nevada Supreme Court recently answered questions certified from the Ninth U.S. Circuit of Appeals concerning the statute of limitations in a declaratory relief and quiet title matter arising out of an HOA foreclosure sale. The federal district court dismissed a bank’s claim for a declaration to quiet title as time-barred before the bank appealed to the circuit court.

Connecticut considers RON work group

The Connecticut General Assembly is considering a bill that would establish a working group to examine and make recommendations regarding whether to adopt the Revised Uniform Law on Notarial Acts. The group also would consider whether remote notarial acts should be permitted in connection with real estate and trusts and estate transactions.

Realtor couple plead guilty to wire fraud scheme

A husband-and-wife Realtor team from Abingdon, Va., pleaded guilty to federal wire fraud charges related to a scheme to create fake residential sales contracts in order to obtain advance sales commissions to which they were not entitled.

Property owner sues for untimely handled lien claim

When seeking to sell property he owned in Ellerslie, Ga., a man discovered a tax lien on the property. He filed a claim with his title insurer, which initially refused to clear the lien, but did so after receiving a formal demand pursuant to Georgia’s bad faith insurance statute, O.C.G.A. Section 33-4-6. The property owner filed suit, seeking damages, bad faith penalties and attorney’s fees arising from the untimely handling of the claim.

Title insurer seeks declaration of scope of loss from titling defect

When a woman purchased property in Damascus, Md., she believed the sale included three attached transfer of development rights. She later discovered it included only one attached TDR and two unattached TDRs. The title insurer conceded the titling defect triggers coverage under the title policies issued to the owner and the lender. It filed suit to determine the scope of loss or damages arising from the titling defect.

Colorado house amends privacy bill

The Colorado House amended a bill to authorize access to records maintained by a county recorder, county assessor, or county treasurer to certain individuals if the access is related to a real estate matter. The house also added to the list of protected persons whose personal information may be withheld from the internet.

Holder of deed of trust sues insurer, parent company for breach of contract

After another party purchased property in Sparks, Nev., at a HOA foreclosure sale, the holder of the deed of trust filed a claim under its title policy. The insurer denied coverage because the lender failed to tender the claim prior to the completion of the HOA lien foreclosure. The deed of trust was assigned to another party and the purchaser of the HOA lien filed a quiet title action against the holder of the deed of trust. The holder of the deed of trust then filed suit against the title insurer.

PRIA announces milestone for eRecording

The Property Records Industry Association announced a new milestone had been reached in the number of recording jurisdictions that are electronically recording documents. As of Jan. 31, 2022, 2,403 recording jurisdictions were eRecording enabled.
