Massachusetts foreclosure bill awaits governor’s signature

The Massachusetts legislature adopted a bill that would clarify the rights of third-party purchasers of previously foreclosed homes in the state. It now awaits the governor’s signature.
The bill, SB 1987, was introduced by the Massachusetts Senate Committee on Ways and Means. It adds language to section 15 of chapter 244 of the General Laws, adopted in 2012, which requires creditors to file affidavits certifying that they have taken reasonable steps to assure that the mortgagee is the holder of the mortgage note or is the authorized agent of the note holder.
