After being foreclosed upon and evicted from his home, a Texas homeowner sued the assignee of his mortgage, arguing that because the Mortgage Electronic Registration Systems Inc. had not acquired the security instrument in the mortgaged property, it therefore could not have assigned its rights to the foreclosing bank.
